Dowell v. Bitner

Bitner terminated his partnership with Dowell and resigned from their related corporation.

Bitner then opened a competing irrigation company.  Dowell sued Bitner claiming breach of fiduciary duty and sought recovery of Bitner’s profits.  Obtained directed verdict from trial court on behalf of Bitner which was later affirmed in part and reversed for a new trial on certain corporate issues.  Following the appeal, judgment was obtained in favor of Bitner on commission’s claims against Dowell. 652 N.E.2d 1372 (Ill. Ct. App. 1995).
