Husband and wife, each with children from prior marriage, sought legal services from attorney. Attorney, without obtaining copy of pre-nuptial agreement that had been entered into by husband and wife, prepared estate plan including joint trusts and property agreements providing for different dispositions of property than provided for by prior agreement.
